PERSONAL DATA
The Law Office of Manfred Keller ("RAK") only collects, processes and uses your personal data with your consent or mandate or order for the purposes agreed with you or if there is another legal basis in accordance with the GDPR; this is done in compliance with the provisions of data protection and civil law.
We only collect personal data that is necessary for the performance and processing of our legal services or personal data that you have voluntarily provided to us.
Personal data include all data that contain individual details about personal or factual circumstances, for example name, address, e--mail address, telephone number, date of birth, age, gender, social security number, video recordings, photos, voice recordings of persons as well as biometric data such as fingerprints. Sensitive data, such as health data or data related to criminal proceedings, may also be included.
INFORMATION AND DELETION
As a client or, more generally, as a data subject, you have the right - subject to the lawyer's duty of confidentiality - to obtain information at any time about your stored personal data, their origin and recipients and the purpose of the data processing, as well as a right to rectify data, transmit data, object to the use of data, to restrict the processing of data as well as block or delete incorrect or unlawfully processed data.
If there are any changes to your personal data, we request that you inform us accordingly. You have the right to revoke your consent to the use of your personal data at any time. Provided that this does not involve a disproportionate effort, your request for information, a deletion, a correction, an objection and/or data transfer, in the latter case, may be addressed to the address of the law firm indicated in this statement.
If you are of the opinion that the processing of your personal data by us violates the applicable data protection law or that your data protection claims have been violated in any other way, you have the possibility to complain to the competent supervisory authority. In Austria, the competent authority is the data protection authority.
DATA SECURITY
Your personal data is protected by appropriate organisational and technical precautions. These precautions especially relate to protection against unauthorised, illegal or even accidental access, processing, loss, use and manipulation. Notwithstanding our efforts to maintain an appropriately high level of due diligence at all times, it cannot be ruled out that information you disclose to us via the internet may be viewed and used by other persons. Please note that we are therefore not able to accept any liability whatsoever for the disclosure of information due to errors in data transmission not caused by us and/or unauthorised access by third parties (e.g. hacking attack on an e-mail account or via the telephone, interception of faxes).
USE OF DATA
We will not process the data provided to us for purposes other than those covered by the mandate agreement, your consent or otherwise by a provision in accordance with the GDPR. This excludes use of the data for statistical purposes, provided that the data that is provided has been anonymised.
TRANSFER OF DATA TO THIRD PARTIES
In order to fulfil your order, it may also be necessary to forward your data to third parties (e.g. the other party, substitutes, insurance companies, service providers that we use and those to whom we make data available, etc.), courts or authorities. Your data will only be forwarded on the basis of the GDPR, especially for the fulfilment of your order or on the basis of your prior consent. Furthermore, we inform you that in the course of our legal representation and support, factual and case-related information is regularly obtained from third parties. Some of the above-mentioned recipients of your personal data are located outside your country or process your personal data there. The level of data protection in other countries may not be the same as in Austria. However, we only transfer your personal data to countries for which the EU Commission has decided that they have an adequate level of data protection or where we take steps to ensure that all recipients have an adequate level of data protection. In which case, we enter into standard contractual clauses (2010/87/EC and/or 2004/915/EC).
DISCLOSURE OF DATA BREACHES
We will endeavour to ensure that data breaches are identified at an early stage and, where appropriate, reported to you or the relevant supervisory authority without delay, including the relevant categories of data that are involved.
RETENTION OF DATA
We will not retain data for longer than is necessary to fulfil our contractual / legal obligations and to defend against any liability claims.
USE OF COOKIES
This website uses "cookies" to make our services more user-friendly, effective and secure. A "cookie" is a small text file that we transfer via our web server to the cookie file of the browser on the hard disk of your computer. This enables our website to recognise you as a user when a connection is established between our web server and your browser. Cookies help us to determine the frequency of use and the number of users of our website. The content of the cookies we use is limited to an identification number that no longer allows any personal reference to the user. The main purpose of a cookie is to recognise visitors to the website. Two types of cookies are used on this website:

Server Log-Files
In order to optimise this website in terms of system performance, user-friendliness and the provision of useful information about our services, the website provider automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. This includes your internet protocol address (IP address), browser and language setting, operating system, referrer URL, your internet service provider and date/time.
We do not combine this data with personal data sources. We reserve the right to check this data retrospectively if we become aware of specific indications of unlawful use.
Google Analytics
If you have consented, this website also uses Google Analytics, a web analytics service provided by Google, Inc ("Google"). This analytics tool uses cookies to collect standard logging information as well as visitor behaviour on our website in an aggregate form. The information generated by this cookie about your use of the website is usually transferred to a Google server in the USA or other states outside the EU and stored there.
The following information is collected by Google Analytics: IP address, browser, device type, device model, country, service provider, screen resolution, time spent on the website, language, operating system, pages visited on the website. Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity.

As indicated in the following detailed information, the setting of cookies on the basis of your voluntary consent may result in the transfer of your personal data to recipients in third countries outside the EU. If there is no adequacy decision by the EU Commission for the third country in question in accordance with Art 45 GDPR, the transfer will take place on a case-by-case basis subject to appropriate safeguards in accordance with Art 46 GDPR or, if applicable, by consent for specific purposes.
LAWYERS' PROFESSIONAL LAW
RAK is subject to supervision by the Vorarlberg Bar Association (Link: Rechtsanwaltskammer Vorarlberg) and is subject to the respective applicable rules of professional conduct and professional law, especially the Code of Conduct for Lawyers (RAO), the Guidelines for Exercising the Legal Profession and for Supervising the Duties of Lawyers and Trainee Lawyers (RL-BA) and the Disciplinary Statute for Lawyers and Trainee Lawyers (DSt).
